3. The condition for ordering goods and conducting a sales transaction is filling out the order form and accepting the regulations.
4. Before placing an order or purchasing products offered in the footbiker.eu online store, the Customer is obliged to read the content of these regulations.

Order fulfillment conditions

4. All prices given on footbiker.eu websites are gross prices in euro.
5. Information about available goods on the website is regularly updated, although it may happen that the ordered goods have been sold out or damaged in storage (although they are still available on the website). In this situation, the customer will be immediately informed about the impossibility of fulfilling the order. If no agreement is reached between parties regarding a proposal for resolving this situation from the store's side, then Customer has no right to any compensation beyond a refund of paid amount. In case when order cannot be fulfilled and payment for goods was made - refund to Buyer will be made immediately.
6. The Buyer places an order through footbiker.eu online store by selecting and adding selected goods to cart and then filling out order form. Personal data indicated in form are used by seller only for purposes related to fulfillment of order placed by Buyer.
7. Each customer registering and/or placing an order agrees to receive information related to course of transaction to their email address provided.
8. After placing an order by Buyer, seller generates an email message to address provided in order which will contain confirmation of order and necessary instructions along with bank account number to which payment for ordered goods should be made. Failure to pay for order by Buyer on indicated bank account number within 7 days from date of placing order will result in cancellation of placed order.
9. Sending an order by Customer constitutes a declaration of intent to purchase specified goods from ke-site company.
10. Sale is considered completed upon receipt of goods by Customer.
11. Seller reserves right to verify content of placed order. In case of justified doubts regarding order e.g., due to content attached by Buyer in note or when provisions of these regulations are not observed, seller has right to withdraw from fulfilling order. In such case, if payment has been made, Buyer will be refunded paid funds. In case of submitting explanations delivery time will be extended by period of submitting explanations.
12. Seller reserves right to make ongoing changes in product prices and conduct and cancel all kinds of promotional actions and sales. Entitlement referred to in preceding sentence does not affect orders placed before date of entry into force of change in price, terms of promotional actions or sales.
§ 6.
Conditions for delivery of ordered goods
1. Products purchased on footbiker.eu are delivered by courier to the delivery address provided by the Customer and confirmed by email after placing the order.
2. The seller is not responsible for delays in delivery or non-delivery due to the provision by the Buyer of incorrect or incomplete data, including an incorrect or incomplete delivery address.
3. Delivery of goods takes place within the territory of the European Union countries to the address indicated by the Customer during placing the order.
4. The total lead time for paid orders is from 3 to about 10 working days.
As a result of introducing government restrictions with unpredictable effects on delivery, there may be additional delays in delivery independent of Seller. Seller will make efforts to inform Customer about any delays.
5. The cost of delivering a scooter is borne by the seller.
6. In case when there are differences in lead time or method of packing and delivery of individual goods making up one order, seller may independently decide to split order into smaller shipments.
7. In case of delivery of incomplete or damaged contents of carton, Buyer should immediately notify seller about this fact (within period not exceeding 7 days from date of receipt of shipment) describing and photographing damages along with preserving original packaging which they decided to accept as proof that they did not accept damaged shipment from courier.
8. Before accepting shipment, Customer is obliged to check condition of packaging in order to exclude damage during transport. Both seller and manufacturer may refuse return/exchange/repair of equipment that was accepted in case of damage resulting from transport.
9. Resignation from order is possible through electronic written form (from Buyer's address to seller's email address) until launch of shipping procedure which precedes moment of handing over goods to courier.
§ 7.
Forms of payment
1. Payment in footbiker.eu online store is made in form of bank transfer to account indicated by seller.
2. Implementation of shipping procedure begins after payment has been credited to account indicated by seller.
§ 8.
Warranty conditions
1. Goods offered by seller through store have manufacturer's warranty.
2. Buyer making complaint about goods is obliged to deliver photos and description of defect to store's email address for analysis of defects and decision by guarantor (manufacturer).
3. In case of defective, factory-damaged or incomplete goods, seller guarantees compliance with warranty, provided that damage is reported immediately and use of damaged product is suspended.
4. Defects revealed during warranty period will be removed by seller or manufacturer of given product. In case of complaint, Buyer purchasing product for purpose not related to professional or business activity has right to file complaint within warranty period counted from date of sales document.
5. After manufacturer's decision regarding warranty claim, seller is obliged to inform Buyer about possibility of repair/exchange/return of goods.
6. Manufacturer's decision regarding recognition of warranty defect is final.
§ 9.
Withdrawal from contract
1. Within 14 days from date of delivery of goods to Buyer, they have right to withdraw from contract without giving reason by submitting appropriate written statement. To meet this deadline it is necessary to send it electronically before its expiry to seller's email address written statement.
2. Condition for exercising right referred to in point 1 is submission of statement using electronic correspondence no later than 14th day (calendar) from date of receipt shipment.
3. When exercising rights described in sections 1 and 2, Buyer should return returned goods to seller's address in condition in which they received it i.e., previously unopened and in particular not assembled without signs of use undamaged complete and in original packaging within 14 days from informing seller about withdrawal from contract. To reduce cost of return there is also possibility after agreeing by email with shop@footbiker.eu of pickup shipment from Buyer by our courier on the day indicated by Buyer.
4. In case of withdrawal from the contract, the cost of returning the goods is borne by the Buyer.
5. Goods returned by Customer should be packed in appropriate way ensuring no damage shipment during transport.
6. In case withdrawal from this agreement store will refund purchase immediately but no later than 14 days from day on which returned goods were received.
7. Refund amount constitutes sales price paid into seller's account reduced by any cost restoring product state new taking into account degree wear damage or spare parts i.e., before shipping Customer.
8. In case when product has been opened and in particular when it has visible signs assembly use or damage then refund amount will either be appropriately lower than sales price or such product will not be subject return within 14-day possibility withdrawal sales contract.
9. In order to return the product, the Buyer will present photographic documentation of the packaging before its dispatch to exclude destruction of the shipment/original packaging by the carrier at the moment of receipt of goods by the seller.
